Terms of Service

The Service is operated by tomy.bio. Questions about these Terms: hello@tomy.bio.

tomy.bio is a link-in-bio and mini-site builder. You can create a public page (and extra pages, a blog, and forms), share a URL, and optionally subscribe to paid features such as Pro (custom domain, AI tools, remove watermark, and similar add-ons as described on the pricing page).

We may change, suspend, or discontinue features. We will try to avoid disrupting paid features without notice, but we do not guarantee that any feature will remain available forever.

You need an account to build and manage a bio. You may sign in with email (one-time code) or Google. You must provide accurate information and keep access to the email you use to sign in.

You are responsible for activity on your account. Notify us if you believe someone else is using it. You must be at least 13 years old (or 16 if you are in the EEA/UK, where a higher age applies). If you use the Service for an organization, you confirm you have authority to bind that organization.

You own the content you upload or create (text, images, links, posts, forms, and similar). You grant us a limited license to host, display, cache, and process that content only as needed to operate the Service — including serving your public pages, generating sitemaps, and providing analytics to you.

You represent that you have the rights to the content you publish and that it does not violate law or these Terms. Public pages are visible to anyone with the URL (and may be indexed by search engines). Do not publish secrets or personal data you are not allowed to share.

Form submissions from your visitors are collected for you. You are the controller of that visitor data; we host it for you. You must have a lawful basis to collect it and must not use the Service to collect sensitive data you are not permitted to process.

You may not use the Service to:

• Break the law, or host or link to illegal content
• Distribute malware, phishing, scams, or deceptive pages
• Infringe copyright, trademark, or other rights of others
• Harass, threaten, or exploit minors, or publish non-consensual intimate imagery
• Attack, scrape, or overload our systems, or bypass access controls
• Resell the Service as a white-label platform without our written permission

We may remove content or suspend accounts that violate this section, including public bios that we reasonably believe are harmful or unlawful.

Some features require a paid plan or add-on. Prices, what’s included, and billing interval (monthly or yearly) are shown at checkout. Paid plans renew automatically at the end of each billing period until you cancel.

Payment is handled by a third-party payment processor. We do not store your full card number. Taxes may be added where required. If a renewal payment fails, we may retry, downgrade your account to Free, or suspend paid features after the current period ends.

We may change prices for future periods. If we do, we will notify you in advance (for example by email) so you can cancel before the new price applies.

You can cancel a paid subscription at any time from your dashboard (Settings → Subscription) using the customer portal link, or by emailing hello@tomy.bio. Cancellation stops future renewals. You keep paid features until the end of the period you already paid for, unless a refund applies under our Refund Policy.

Refunds are described in our Refund Policy, which is part of these Terms. Statutory consumer rights are not limited by that policy.

The Service (software, design, trademarks, and documentation) is owned by us or our licensors. These Terms do not transfer any ownership to you. You may not copy, reverse engineer, or reuse our branding except as needed to use the Service.

The Service relies on third parties for hosting, sign-in, image storage, analytics, optional AI features, and payments. Links you add to your bio go to sites we do not control. Those services have their own terms; we are not responsible for them.

The Service is provided “as is.” We do not warrant uninterrupted or error-free operation, or that the Service will meet a particular purpose. To the extent allowed by law, we disclaim implied warranties of merchantability, fitness, and non-infringement. Nothing in these Terms limits rights that cannot be waived under consumer law.

To the extent allowed by law, we are not liable for indirect, incidental, special, consequential, or lost-profit damages, or for loss of data or goodwill. Our total liability for claims arising from the Service is limited to the amounts you paid us for the Service in the 12 months before the claim (or, if you are on Free, fifty US dollars). These limits do not apply to liability that cannot be limited by law (for example, death or personal injury caused by negligence, or fraud).

You may stop using the Service and delete your account at any time from settings or by contacting us. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. After termination, we may delete your content after a reasonable period, except where we must retain records (for example billing). Public URLs may become available to others after you release a username.

We may update these Terms. The “Last updated” date will change. If a change is material, we will provide notice (for example on the website or by email). Continued use after the effective date means you accept the updated Terms. If you do not agree, cancel and stop using the Service.

These Terms are governed by the laws applicable to the operator of tomy.bio, without regard to conflict-of-law rules. If you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction with mandatory consumer protections, you retain those rights and may bring claims in your country of residence.
